TERMS & CONDITIONS OF USE
Use of the UNESCO Center for Global Friendship, Inc. (“UCGF”) website, www.unescocgf.org and all pages in this domain (together, the “UCGF website”), constitutes acceptance of the following Terms and Conditions of Use. UCGF reserves the right to seek all remedies available by law for any violation of these Terms & Conditions of Use (“Agreement”), including any violation of UCGF’s rights in the UCGF name and emblem and its rights in connection with the information, artwork, text, video, audio, or pictures (together, the “Content”) of the UCGF website.
The Agreement is a contract between you (“you”) and UCGF and governs your access and use of the www.unescogf.org website and all other websites owned and operated by UCGF that have this Agreement posted, including, but not limited to, all transactions conducted on the UCGF website and all UCGF services provided in connection with the UCGF website. By accessing or using the UCGF website, you signify that you have read all of the terms and conditions in, and linked to, this Agreement (including the Privacy Policy), and you agree to be bound by this Agreement, whether or not you participate in UCGF’s related programs, services or activities (collectively, the “Program”) or otherwise access or use the UCGF website (in each such capacity, a “User”). If you do not agree with all of the terms and conditions in this Agreement, please do not participate in the Program or access or use the UCGF website.
Without advance notice and at any time, we may, for violations of this Agreement or for any other reason we choose: (1) suspend your access to the UCGF website, (2) suspend or terminate your account or membership, and/or (3) remove any of your User Content from the UCGF website.
The UCGF Name and Emblem
The UCGF name and emblem are the exclusive property of UCGF. They are protected under the laws of the United States.
The UCGF Web Site
The UCGF website is provided by UCGF for personal use and educational purposes only. UCGF wishes to enhance public access to information about its activities, and it maintains this website, and the information, documents and materials presented herein, for informational purposes only. Any other use, including reproduction or translation of anything more than a de minimis portion of the Content of the UCGF website, or any use other than for personal or educational purposes, requires the express prior written permission of UCGF. Requests for copyright permission should be sent to us via email at info@unescocgf.org, specifying full details of the proposed use. All Content of the UCGF website is protected by law including, as applicable, copyright laws.
The Content of the UCGF website is selected on the basis of UCGF’s own criteria and in its own sole discretion. UCGF reserves the right at any time to change or discontinue any aspect or feature of the UCGF website, including but not limited to these terms of use, hours of availability and equipment needed for use.
As UCGF’s mission is to engage a global demographic about national and international issues, the use of particular designations of countries or territories does not imply any judgment by UCGF as to the legal status of such countries or territories, of their authorities and institutions or of the delimitation of their boundaries. The mention of names of specific companies or products (whether or not indicated as registered) does not imply any intention to infringe proprietary rights, nor should it be construed as an endorsement or recommendation on the part of UCGF.
UCGF disclaims any liability or responsibility arising from the use of the UCGF website or the Content of the UCGF website. UCGF, members of their staff, and their contractors, shall not be liable for any financial or other consequences whatsoever arising from the use of the Content of the UCGF website, including the inappropriate, improper, or fraudulent use of such Content.
No representations or warranties of any kind concerning the UCGF website are given, including responsibility for any infection by virus or any other contamination or by anything which has destructive properties.
Other Web Sites
The UCGF website may be linked to other web sites that are not under UCGF’s control. UCGF provides these links merely as a convenience and the inclusion of such links does not imply an endorsement or approval by UCGF of any web site, product or service. UCGF does not assume any responsibility or liability in respect of such web sites, including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made on those web sites.
Interactive Parts of the UCGF Website
The UCGF website may contain bulletin boards, chat rooms, testimonials, opinion pages, access to mailing lists, or other related message or communication facilities. The user hereby agrees, when taking advantage of such facilities, not to do any of the following: (a) defame, abuse, harass, stalk, threaten or otherwise violate the legal, moral, or human rights of others (such as rights of privacy and publicity); (b) publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information; (c) upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy) unless the user owns or controls the rights thereto or has received all necessary consents; (d) upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer; (e) delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded; (f) falsify the origin or source of software or other material contained in a file that is uploaded; (g) advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters; or (h) download any file posted by another user that the user knows, or reasonably should know, cannot be legally distributed in such manner. UCGF reserves the absolute right to delete any material posted to the UCGF website without notice to the user.
Compliance With the Digital Millennium Copyright Act (“DMCA”)
UCGF will respond to legitimate requests under the Digital Millennium Copyright Act (“DMCA”), and hereby retains the right to remove user content on the UCGF website that we deem to be infringing the copyright of others. If you become aware of user content on the UCGF website that infringes your copyright rights, you may submit a properly formatted DMCA request (see 17 U.S.C. § 512) to UCGF by emailing info@unescocgf.org.
Comments and other Information
Please be aware that the submission of comments or information through other similar mediums will be published in a public forum and subject to many kinds of different users of different age and levels of experience. UCGF does not assume responsibility for monitoring of the material posted and published. Your use of public forums, for example, comments, message boards and chat rooms is at your own risk and you are solely responsible for all and any actions you take as well as for all and any actions that you take based on information gained on such public forum.
Waiver of Liability
UCGF accepts no responsibility or liability in respect of the conduct of any user in connection with such communication facilities described herein, or for any material submitted by users and carried on the UCGF website including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made in such material.
Eligibility
UCGF’s services are available for users who are thirteen (13) years of age or older. Notwithstanding the foregoing, if you are deemed as a minor under the legislation of your country, you should review this Agreement with your parent or legal guardian and obtain their prior approval for registration and/or use of UCGF’s website.
Disclaimer of Warranties
UCGF does not warrant that the information, documents, and materials contained in its website is complete and correct and shall not be liable whatsoever for any damages incurred as a result of its use.
The UCGF website, as well as content and user content thereof, are provided by UCGF on an “as is” and “as available” basis. The organizers do not warrant that this site will be uninterrupted or error or virus-free. UCGF reserves the right to revise the site or withdraw access to it at any time without notice to you. UCGF expressly disclaims any express or implied warranties including, without limitation, warranties of title, non-infringement, merchantability, fitness for a particular purpose, availability, accuracy, reliability or content of these pages.
You expressly agree and acknowledge that the use of UCGF’s services and programs is at your sole risk and that you are exposed to user content from various sources. UCGF assumes no liability or responsibility for any content or information provided by other users.
Privacy Policy
Personal information shall be considered as being your name, gender, address, e-mail address, country of residence, and phone number (“personal data”). Personal data may be submitted by you on or through this website and/or collected in the course of providing programs or services in accordance with the UCGF’s Privacy Policy.
You acknowledge that the Privacy Policy explains how we track your usage of the service and process your personal data thereto including without limitation the purposes for which personal data is used. Governing Law and Settlement of Disputes
This Agreement shall be governed by the laws of Connecticut without regard to any conflict of laws principles. The Parties shall use reasonable efforts to settle amicably by negotiation any dispute, controversy or claim rising out of, or relating to this Agreement or the breach, termination or invalidity thereof.
Order of Prevalence
In case of any conflict or inconsistency between the Agreement and the Privacy Policy, each such document shall prevail over the other(s) in the following order:
1) Agreement; and
2) Privacy Policy.
Indemnity
You agree to defend, indemnify and hold harmless UCGF, members of their staff, , their agents, and their contractors from and against any and all third party claims and all liabilities, assessments, losses, costs or damages resulting from or arising out of: i) your breach of this Agreement or Privacy Policy; ii) your infringement or violation of any intellectual property, other rights or privacy of a third party.
Assignment
UCGF shall have the right to assign this Agreement and the Privacy Policy or its rights and obligations hereunder to a third party without your prior written consent, but may not be assigned by you without UCGF’s prior written consent.
General
This Agreement together with the Privacy Policy and other legal notices submitted by UCGF constitute the entire agreement between you and UCGF regarding the use of the UCGF website. The failure of UCGF to exercise any right of this Agreement shall not be considered as a waiver of such right. If any provision of this Agreement is considered unlawful or void, it does not affect the validity and enforceability of other provisions of this Agreement. A failure of UCGF to insist upon the performance of one or more of the terms of the Agreement and Privacy Policy shall not be deemed to be a waiver of its rights to enforce such terms, or of any rights or remedies UCGF may have in subsequent similar situations. It is your responsibility to review the Agreement and Privacy Policy regularly to ensure that you are up to date as to any changes in the Agreement and Privacy Policy.
